Sport Fishing comes with unavoidable inherent Risks.

Many of the following fishing related activities can pose risks of injury or death:

• fighting a large Sturgeon. This is a physically intensive sport and those with heart problems are at risk of harm. Handling of the rod in a improper way may lead to bruises, muscle ache, and other injuries.
• Hiking to and from a fishing spot. Risks include tripping, falling and encounters with wildlife.
• Boarding and unboarding the boat either at the dock or shoreline.
• Hooks, knives and gaffs are part of fishing and thus unavoidable.
• Not listening to or obeying common safety protocols such as but not limited to: staying off the bow of the boat, jumping off the boat, wading into dangerous river depth and current speed.

I agree to the following Waiver and Release: I am aware that I am being GUIDED and TRANSPORTED by a angling guide employed or contracted by Silversides Fishing Adventures(SFA). I acknowledge that Fishing involves inherent risks, hazards and dangers associated with outdoor activities in the back country and river wading that cannot be eliminated. I UNDERSTAND THAT THESE RISKS, HAZARDS AND DANGERS INCLUDE WITHOUT LIMITATION:

• Water hazards and wading in rivers including drowning;
• Hiking in rugged country;
• Injuries from fishing equipment and other participants;
• Encounters with wildlife, animals, and insects;
• Temperature and weather extremes, and unavailability of immediate medical attention in the wilderness in case of injury;
• Risks associated with driving to and from the fishing destination.

I understand that no Guide service can Guarantee absolute Safety in wilderness environments or fishing related activities. I understand that I assume all responsibility for any negligence. I AFFIRM that my general health is good, and that I am not under a doctors care for any condition that might endanger the life or health of myself or others participating in this activity. I understand that I have responsibilities. My participation in this activity is purely voluntary. Noone is forcing me to participate, and I elect to participate despite the risks. I AM VOLUNTARILY USING THE SERVICES OF SFA WITH FULL KNOWLEDGE OF THE INHERENT RISKS, HAZARDS AND DANGERS INVOLVED AND HEREBY ASSUME AND ACCEPT ANY AND ALL RISKS OF INJURY, PARALYSIS, OR DEATH.

I expressly assume the risks of personal injury, death and property damage set forth above and waive any claims based on negligence or breach of warranty I might assert on my own behalf against SFA and any of it’s employees or contractors for personal injuries, death, and/or property damage sustained while participating in any fishing charter with SFA.
